While illegal and unregulated gambling was a growing problem before the COVID-19 crisis, today the enormous backlog in the courts and criminal justice system will push the prosecution of illegal gambling further down the list of priorities. Meanwhile, legal gambling operations will emerge under a variety of regulatory controls to protect patron health.
These factors create an enhanced risk that unregulated gambling will feel emboldened by greatly reduced chances of prosecution, promoting even greater growth while placing consumers at risk and eroding state and tribal public policy relating to gambling.
